1. Scope
1.1. These general terms and conditions (GTC) apply to the entire business relationship between the company SLS Marketing GmbH - Schumann 7.83® and its corporate and private customers.
2. Conclusion of contract and withdrawal
2.1. The presentation of the Schumann 7.83® products, particularly on the Internet, does not constitute a binding offer.

3. Privacy
The contractual partner agrees that all customer and delivery-related data will be stored and processed using electronic data processing by SLS Marketing GmbH.
4. Order and Terms of Delivery
4.1. Orders are placed without exception in our online shop or in the associated sales platform.
4.2. Unless otherwise agreed, delivery is made ex warehouse to the customer's address.
4.3. If SLS Marketing GmbH incurs additional shipping costs due to the specification of an incorrect delivery address or an incorrect arrestee, these costs must be reimbursed by the customer, unless he is not responsible for the incorrect information.
4.4. Information on delivery times is generally non-binding unless the delivery date has been bindingly promised in individual cases. Partial deliveries are permitted. Agreed delivery times apply subject to and foreseeable obstacles that are beyond the sphere of influence of SLS Marketing GmbH, especially in cases of force majeure, lack of material, Covid 19 measures, etc. Claims for damages or cancellation of the contract due to delivery delays are excluded.
5. Terms of Payment
5.1 The purchase price is due immediately upon acceptance of the customer's order. The customer is generally obliged to pay in advance. The payment is deemed to have been made on the day on which SLS Marketing GmbH can dispose of it.
5.2. Prices are end customer prices including statutory VAT.
5.3. In the event of default of payment, the end customer is obliged to pay default interest of 5% to SLS Marketing GmbH. If the customer is a dealer, default interest is 8% above the base rate.
5.4. In the event of default, the customer undertakes to reimburse the reminder and collection fees incurred.
6. Passing of Risk, Default of Acceptance
Shipping is always at the expense and risk of the customer. SLS Marketing GmbH is not liable for damage or loss during transport.
In principle, SLS Marketing GmbH sends all deliveries as an insured package.
7. Retention of Title
The goods remain the property of SLS Marketing GmbH until full payment has been made.
8. Liability and Guarantee
8.1. SLS Marketing GmbH guarantees for a period of 24 months via the producer's manufacturer's guarantee that the goods have the promised properties and have no defects that would impair their value or suitability for the intended use. Scratches in the surface of the copper plates and possible discolouration are excluded.
8.2 The buyer must check the delivered goods upon receipt and report any defects to SLS Marketing GmbH immediately.
8.3. Damage caused by improper measures taken by the buyer when unpacking or installing does not justify any claims against SLS Marketing GmbH
8.4. If a product has a defect, SLS Marketing GmbH has the choice of making repairs free of charge, making a deduction from the price corresponding to the reduced value, or making a replacement delivery.
9. Right of Withdrawal
As a consumer (webshop end customer) you can revoke your contractual declaration within 14 working days without giving reasons in writing (e.g. letter, e-mail) or by returning the unused and originally packaged goods. The period begins on the day after receipt of the goods. The revocation must be sent to the following address or email address:

10. Limitation of Liability
SLS Marketing GmbH is only liable for damages that can be traced back to grossly negligent behavior.
11. Advertising and Marketing
11.1 All business partners and dealers who buy and sell products from Home of Balance, in particular the Schumann 7.83® brand, may only use photos, videos, images and texts released by SLS Marketing GmbH, Schumann 7.83® for use their advertising and marketing, both online (social media, Google, internet, online copywriting) and offline. The same also applies to the online shop of a business partner or retailer. If business partners or dealers do not comply with the specifications under point 11.1, SLS Marketing GmbH, Schumann 7.83® will immediately end the cooperation with the business partner or dealer and also take legal action against him.
If business partners or dealers want to use their own photos, videos, images and texts in their online shop and in their advertising and marketing, this must be sent by email to SLS Marketing GmbH, Schumann 7.83® and approved by SLS Marketing GmbH, Schumann 7 .83® in written digital form via email.

12. Timeliness of the GTC
As of September 1st, 2022. There is no legal obligation for earlier versions of the General Terms and Conditions

13. Austrian law applies. The place of jurisdiction is the registered office of SLS Marketing GmbH.
